Hillary Taylor Authors Amicus Brief in U.S. Supreme Court

Hillary Taylor authored DRI Center for Law and Public Policy amicus brief in support of Respondents Dr. Choy and Beebe Medical Center in the case of Berk v. Choy, https://www.scotusblog.com/cases/case-files/berk-v-choy/. The question on review is whether a state law providing that a complaint must be dismissed unless it is accompanied by an expert affidavit may be applied in federal court.  The petitioner’s medical malpractice case was dismissed when the court applied Delaware’s affidavit of merit requirement and the petitioner failed, for five months, to comply with the statute and file the required affidavit of an expert indicating that there were “reasonable grounds to believe there has been health-care related negligence.”  The Center’s brief urges the Supreme Court to affirm the Third Circuit Court of Appeals and conclude that Delaware’s affidavit of merit requirement does not conflict with the Federal Rules. Peter Tuenge Shares Strategic Insights on Anchoring Damages at National Defense Counsel Conference

Peter Tuenge was recently a featured speaker at a national defense counsel conference in Chicago, Illinois.  Peter spoke about his experience anchoring damages, and shared thoughtful insights about how best to approach the often difficult task of providing juries in personal injury trials a damages analysis or even a specific damages number alternative to the plaintiff’s.  Peter also facilitated a lively group discussion on the subject with lawyers from all across the country sharing their experiences and techniques.

Peter Eidenberg Shares Strategies to Prevent Sexual Misconduct in Health Care Settings

Peter Eidenberg was recently the featured speaker as part of Physicians Insurance’s Risk Factors series. The presentation was via live webcast to hundreds of providers and risk managers throughout the Pacific Northwest. Peter’s presentation, titled Protecting Patients and Providers: Strategies for Preventing Sexual Misconduct, provided an engaging discussion on the issue of provider sexual misconduct. During the presentation, Peter shared from his experiences defending providers accused of impropriety by patients and offered recommendations on how to avoid interactions that may leave a patient feeling uncomfortable or confused with their care and treatment. He also provided recommendations on ways to reduce the risk of providers blurring boundaries with their patients and how to respond to patient complaints of sexual misconduct. The informative, hour-long presentation was one the most well-attended of the Risk Factors series.

Huge Win: Peter Tuenge, Melissa Tahir, and Paralegal Lily Boynton Obtain Defense Verdict in Labor and Delivery Malpractice Lawsuit

Shareholder Peter Tuenge and senior counsel Melissa Tahir, with the help of paralegal Lily Boynton, obtained a defense verdict on behalf of Legacy Health and Legacy Salmon Creek Hospital in Clark County, Washington in May 2025.  The case was remarkable in many ways, including that the plaintiffs asked the jury for $75,000,000, which was the largest ask for damages to a jury on a personal injury case in the history of Legacy Health.  Plaintiffs claimed the hospital nurses were negligent by not notifying the attending obstetrician that delivery was imminent, which resulted in a nurse-only attended delivery.  Plaintiffs claimed that because there was no obstetrician present to deliver the baby the plaintiff mother suffered a grievous vaginal tear causing permanent vaginal and rectal dysfunction.  After six days of trial, the jury returned a unanimous verdict in favor of […]

Anna Claypool and Peter Tuenge Obtain Summary Judgment Dismissal of Washington Medical Malpractice Lawsuit

Anna Claypool and Peter Tuenge successfully obtained summary judgment resulting in dismissal for their client on the grounds that the plaintiff’s claims were not supported by expert opinion.  This case involved complex medical treatment in an emergency department that undoubtedly required expert support on standard of care and causation.  In medical malpractice matters in Washington, a party must disclose a detailed expert affidavit to overcome a motion for summary judgment.  Anna and Peter advocated to the court that it is critical a plaintiff has adequate expert support on each element of every specification of negligence when pursuing a complex medical malpractice lawsuit.  Their briefing and oral argument resulted in the complete dismissal of all claims against their client.

Hillary Taylor has been appointed Chair of DRI’s Appellate Advocacy Committee.  The committee seeks to improve the appellate system by improving the quality of appellate lawyering.  DRI is the largest international membership organization of attorneys representing interests of businesses and individuals in civil litigation.  Congratulations, Hillary.

Peter Tuenge, Colleen Scott, and Paralegal Kristin Francis Obtain Defense Verdict in Labor and Delivery Malpractice Lawsuit

Shareholder Peter Tuenge and senior counsel Colleen Scott, with the help of paralegal Kristin Francis, obtained a defense verdict on behalf of a local hospital in a multi-million dollar medical malpractice lawsuit in Multnomah County, Oregon in October 2024.  Plaintiff claimed her obstetricians and hospital nurses were negligent in their management of her labor and delivery, and in their postpartum management of the plaintiff’s claimed nerve and bladder injuries caused during the labor and delivery.  Plaintiff claimed the negligence resulted in permanent pelvic nerve pain, permanent bladder dysfunction, PTSD, and severe emotional distress.  After ten days of trial, the jury returned a verdict in favor of the hospital nursing staff.

Defense Team Secures Victory in $10M Multnomah County Medical Malpractice Case Involving Recalled Medical Device

Peter Eidenberg and Carolyn Pearson, with the help of paralegal Amber Zorra, obtained a defense verdict in a Multnomah County medical malpractice lawsuit seeking over $10 million dollars in damages. Plaintiff claimed that she suffered injuries as a result of the placement of a transvaginal mesh at a local hospital.  Plaintiff alleged that the hospital should not have permitted the mesh to be used at the hospital because it was recalled by the product manufacturer prior to the plaintiff’s surgery.  The plaintiff also alleged the co-defendant physician did not obtain her informed consent for use of the device. After an eight-day trial in August 2024, the jury returned a verdict in favor of the hospital and the physician, finding no negligence with respect to either defendant.

Carolyn Pearson Secures Defense Award in Dental Malpractice Arbitration

Carolyn Pearson obtained a defense award in a dental malpractice arbitration in Clark County, Washington in April 2024.  Plaintiff claimed a local dentist negligently fitted a set of dentures.  After a day and a half of testimony, the arbitrator found in favor of the defendants.

Molly Marcum presents on Advocacy before Health Licensing Boards and removing barriers to provider well-being.

Attorney Molly Marcum presented to the Oregon State Bar Health Law Section at their February 2024 CLE series on “Medical Regulatory Authorities and Boards:  Protecting the health and well-being of the public . . . and of health providers?”  She shared perspectives on advocacy before health licensing boards,  understanding the role and scope of licensing boards, and thoughts on reducing barriers to provider well-being.

Peter Tuenge, Colleen Scott and paralegal Linda Sandeen Obtain Defense Verdict in Dental Malpractice Lawsuit

Peter Tuenge, Colleen Scott, and paralegal Linda Sandeen obtained a defense verdict in a dental malpractice lawsuit on February 13, 2024, in Washington County Circuit Court in Hillsboro, Oregon.  Plaintiff claimed our client, a general dentist, was negligent and failed to obtain her informed consent for dental procedures, including placement of veneers.  Plaintiff sought damages in excess of $2 million.  After a four day trial, the jury returned a verdict for defendants.

Peter Eidenberg and Kevin Gambee Obtain Defense Verdict In Medical Malpractice Lawsuit

Peter Eidenberg and associate attorney Kevin Gambee obtained a defense verdict in a medical malpractice lawsuit on November 20, 2023 in Multnomah County Circuit Court in Portland, Oregon. Plaintiff brought claims alleging our client, an orthopedic surgeon, performed multiple medically unnecessary procedures rather than performing a total knee replacement. Plaintiff sought damages in excess of $1.3 million. After a trial that spanned six days, the jury returned a unanimous verdict in favor of our client, the orthopedic surgeon.

Peter Tuenge and Trent Andreasen Obtain Defense Verdict in Dental Malpractice Lawsuit

Peter Tuenge and associate attorney Trent Andreasen obtained a defense verdict in a dental malpractice lawsuit on November 17, 2023, in Deschutes County Circuit Court in Bend, Oregon.  Plaintiffs brought claims for failure to identify, treat, and diagnose oral tongue cancer against three general dentists and two dental clinics.  Plaintiffs sought damages in excess of $25 million.  After a trial that spanned 3 weeks, the jury returned a verdict for the defendants.

KJH Defense Verdict

On March 22, 2023, Peter Eidenberg and associate attorney Trent Andreasen obtained a defense verdict in the Multnomah County Circuit Court in Portland, Oregon.  The plaintiff brought a medical negligence lawsuit seeking $3.2 million in damages against an OB-GYN for care provided in Tillamook, Oregon.  The plaintiff alleged she suffered permanent bladder injury following a hysterectomy procedure.  After 8-day jury trial, the jury returned a verdict for the defense.

Colleen Scott Presents “Tort and Liability for Nurse-Midwives”

Colleen Scott recently presented “Tort and Liability for Nurse-Midwives” to a group of midwifery students as part of their advanced practicum in nurse-midwifery management.  Her presentation focused on key issues with medical malpractice litigation from a practice standpoint as well as how best to assist with and prosper during any litigation, should it arise.  Colleen enjoys the opportunity to connect with new midwives about to embark on their practice and the students appreciate her unique perspective which both acknowledges particular risks to midwives and recognizes their strengths as healthcare providers.
