Defense Verdict in $13 Million Dollar Labor and Delivery Lawsuit
Shareholder Peter Tuenge and senior counsel Colleen Scott, with the help of paralegal Kristin Francis, and shareholder and appellate lawyer Hillary Taylor, obtained a defense verdict on behalf of Samaritan Health Services in Benton County, Corvallis, Oregon, in March 2026. Plaintiff claimed her obstetricians and a midwife did not obtain her informed consent for a C-section delivery of her baby, negligently performed the delivery, and misled her about her delivery options. She also sued the anesthesiologist for negligence claiming permanent spinal cord injury from a negligent spinal anesthetic during the C-section. In addition to compensatory damages, plaintiff sought punitive damages. Her total ask of the jury was $13,000,000. After thirteen days of trial, the jury returned a quick defense verdict. This is Peter’s third labor and delivery defense verdict in a row, in a year and a half.
