Peter Eidenberg and Robert Sinnott prevailed on a motion for summary judgment in the U.S. District Court for the District of Oregon. The professional liability lawsuit involved claims against a law firm for violations of the Federal Debt Collections Practices Act (FDCPA) based on allegations that (1) it did not strictly comply with Oregon’s model debt calculation form and (2) it misstated the debt amounts by attempting to collect less than what plaintiff actually owed. The Honorable Magistrate Judge Youlee Yim You granted summary judgment on all claims, finding the defendant law firm did not violate the FDCPA and plaintiff did not suffer any actual injury.
